Medicaid: Countable Assets, Penalties and Exempt Transfers
This session will explore what is meant by countable and non‐countable assets for purposes of Medicaid eligibility, the rules as they relate to gifting, what exempt transfers are allowed, and how to calculate the Community Spouse Resource Allowance (CSRA) and Minimum Monthly Maintenance Needs Allowance (MMMNA) for married couples.

Crisis Planning Strategies
During this session attendees will learn “must‐know” crisis planning strategies allowed under current federal law, a process to evaluate a crisis planning case and how to determine what is applicable in their own state.

We will begin the afternoon sessions by talking about how to intake clients successfully, including reviewing effective intake documents, discussing how to qualify a client, and talking about handling public inquiries. We will discuss three models of law practices and how to tailor the client intake process for each model.

Special Topics When Dealing with Special Needs or Elderly Clients
Here, we will discuss etiquette and terminology that should be used in elder law, along with how and when to provide accommodations to clients. We will provide an overview of dementia, indicators of incapacity, and how to deal with family members and caregivers. Finally, we will discuss how to recognize and report elder abuse.

How to Complete a Medicaid Application
In this session, we will discuss how attendees can access their state’s online Medicaid application and eligibility rules, whether a paper application is preferred over an online application, common attachments to a Medicaid application, the application process and deadlines, and common responses from Medicaid offices.

How to Fund a Trust
In this session, we will review how to properly fund a trust with various assets, including business interests, financial accounts, and real property. We will talk about real estate ownership, descriptions, deeds, and verifications. We will also instruct attendees on proper beneficiary designations when naming a trust as a beneficiary.
