About The Event

Do you work at an elder law firm but would like more substantive legal knowledge about the Medicaid cases you work on? Are you an attorney that manages staff and you don’t have time to teach them Medicaid rules and strategy?

If you answered “Yes, holy cow how do they know me so well?” to either question then this course is here to help.

This course is for non-attorney staff members at elder law firms. It is an introduction into the area of Medicaid planning. We will cover the basic rules and strategy of Medicaid planning, trusts used in this planning area, and how to use the ElderDocx document assembly system to support your clients.

This course will provide an opportunity to gain hands-on drafting experience and familiarity with the tools provided by your ElderCounsel membership.

Medicaid: Countable Assets, Penalties, and Exempt Transfers
This session will explore what is meant by countable and non‐countable assets for purposes of Medicaid eligibility, the rules as they relate to gifting, what exempt transfers are allowed, and how to calculate the Community Spouse Resource Allowance (CSRA) and Minimum Monthly Maintenance Needs Allowance (MMMNA) for married couples.

During this session attendees will learn “must‐know” crisis planning strategies allowed under current federal law, a process to evaluate a crisis planning case, and how to determine what is applicable in their own state.

Crisis Planning Case Study and Drafting
Here, we will delve into a sample client scenario for a crisis planning case. We will talk about how to spot issues within their case and how to best plan for their situation. We will walk through how to draft a Medicaid Asset Protection Letter (MAPL) for the client and review the final MAPL together.

During this session, you will use the crisis planning case study and create a MAPL. We will be “on hand” to help with any questions and make sure your final letter is complete and you fully understand the process of completing the various answers and selections in ElderDocx.

Proactive Planning: Adding the Medicaid Asset Protection Trust to Your Practice
This session will start with an overview of trust basics and continue with a look at the federal rules authorizing the use of an irrevocable Medicaid Asset Protection trust, the tax implications of this type of trust, and the circumstances under which this type of trust may be used. We will continue to explore the Medicaid Asset Protection Trust and how to draft the document to accomplish all of your client’s asset protection goals, distributions plans, and end of life consequences.

Proactive Planning Case Study and Drafting
This session will focus on a case study for a proactive planning case. We will discuss how to spot issues in the case, how best to plan for their specific set of facts, and we will draft a Medicaid Asset Protection Trust (MAPT). Finally, we will talk about how to fund the trust. During this session you will use the proactive planning case study and put a MAPT together using a design sheet from case facts. We will be “on hand” to help with any questions and make sure your trust is complete and you fully understand the process of completing the various answers and selections in ElderDocx.
