DAY 1:
You'll join the attorneys for a day of education on Medicaid rules and strategies.

DAY 2:
You’ll have your own day to learn how to apply what you’ve learned, and how to create more efficient workflows for your office. With topics ranging from how to talk to prospects and get important information before a meeting, to how to complete a Medicaid application, as well as how to utilize the ElderDocx® design sheets for drafting documents, you’ll leave with legal technical knowledge, and be armed with tools to make you and your office more efficient.

Medicaid: Countable Assets, Penalties and Exempt Transfers
This session will explore what is meant by countable and non‐countable assets for purposes of Medicaid eligibility, the rules as they relate to gifting, what exempt transfers are allowed, and how to calculate the Community Spouse Resource Allowance (CSRA) and Minimum Monthly Maintenance Needs Allowance (MMMNA) for married couples

Crisis Planning Strategies
During this session attendees will learn “must‐know” crisis planning strategies allowed under current federal law, a process to evaluate a crisis planning case and how to determine what is applicable in their own state.

Group Work: Looking up Strategies in Your State
Each attendee will work on finding state specific rules, and will be responsible for looking up their state’s Medicaid rules for at least 3 strategies. Instructors will assist as needed.

Attendees will work through case studies on their own, and then discuss as a group. Attendees will apply their own state’s rules to determine planning strategies.

We will begin the day by talking about how to intake clients successfully, including reviewing effective intake documents, discussing how to qualify a client, and talking about handling public inquiries.

How to Complete a Medicaid Application
In this session, we will discuss how attendees can access their state’s online Medicaid application and eligibility rules, whether a paper application is preferred over an online application, common attachments to a Medicaid application, the application process and deadlines, and common responses from Medicaid offices.

Here, we will discuss what ElderDocx is and what documents can be generated with ElderDocx. We will show attendees how to effectively use ElderDocx, including the use of design sheets, comments, work with names, an annotated document, and built-in scenarios.

How to Fund a Trust
In this session, we will review how to properly fund a trust with various assets, including business interests, financial accounts, and real property. We will talk about real estate ownership, descriptions, deeds, and verifications. We will also instruct attendees on proper beneficiary designations when naming a trust as a beneficiary.

Who is your client? What are the rules concerning client confidentiality? What is the unauthorized practice of law? We will answer these questions, and also talk about conflicts of interest and what it means for someone to serve in a fiduciary role.

Special Topics When Dealing with Special Needs or Elderly Clients
Here, we will discuss etiquette and terminology that should be used in elder law, along with how and when to provide accommodations to clients. We will provide an overview of dementia, indicators of incapacity, and how to deal with family members and caregivers. Finally, we will discuss how to recognize and report elder abuse.

Let’s talk marketing! We will give attendees tips on blogs, social media, and newsletters. We will talk about ethics in marketing with regard to content and solicitation rules.
