Overview of the VAPT
In this session, we will learn why a different trust is necessary for VA Pension planning and discover drafting rules that can never be broken.

How the VAPT Works
First, we will ensure attendees understand the concepts of the residence subtrust and the nongrantor subtrust. Then, we will discuss income distributions, grantor vs. nongrantor status, and estate inclusion. We will talk about gift and estate tax consequences of each subtrust.

Let’s talk about the choice of trustee, and the difference between an interested trustee and an independent trustee. We will review the powers and restrictions of a trustee available in the VAPT. We will also discuss what a distribution trustee is and how that role might be beneficial to include in the trust.

Design of the Lifetime Trust
We will talk about the choice of lifetime beneficiaries, and discuss why income must be paid to lifetime beneficiaries and the tax consequences of this requirement. We will also discuss the distribution standards available in the VAPT.

This session is all about trust protectors; who they are and why they are important in VAPT. We will discuss trustee removal options, trust termination power, and trust protector designators.

Trust Funding and Administration
What tax ID numbers should be used? How are each subtrust administered? How should payments of real estate closing proceeds be properly paid to the VAPT? We will discuss these issues, along with tips for funding the VAPT properly.

We will show attendees helpful tips and tricks when using ElderDocx, including how to import contacts and how to use scenarios and design sheets. We will demonstrate how to customize ElderDocx provisions and discuss the benefits of an annotated document.

Talking About the VAPT to Others
We will give attendees tips on how to speak to clients and referral sources about the VAPT. We will also give attendees the tools necessary to properly convey the taxation scheme of the VAPT to CPAs. Finally, we will wrap up the day by giving attendees tips on marketing the VAPT.
